By accessing or using SameDayMedical.ca, requesting a delivery, or making a payment, you agree to these Terms of Service and our Privacy Policy.

What SameDayMedical.ca Is, and Isn’t
SameDayMedical.ca is a same day medical equipment and supply delivery coordination service. We arrange the pickup and delivery of medical equipment, mobility aids, home care furniture, medical supplies, and related items to individuals, families, clinics, and healthcare providers across Metro Vancouver and the Lower Mainland of British Columbia.
SameDayMedical.ca is a delivery coordination service, not a medical advice service.
We do not provide medical, clinical, pharmaceutical, psychological, legal, financial, or other professional advice. The availability of any item for delivery through our service does not constitute a recommendation, endorsement, or professional assessment of that item’s suitability for your particular medical needs or circumstances.
You are responsible for ensuring that any medical equipment or supplies you order are appropriate for your needs. We strongly recommend consulting a qualified healthcare professional before making decisions about medical equipment or supplies.
We are not a pharmacy, medical equipment retailer, or healthcare provider. We coordinate delivery on your behalf and do not independently assess, inspect, certify, or validate the medical equipment or supplies being delivered unless expressly stated.
Who Can Use SameDayMedical.ca
You must be at least 18 years old to use SameDayMedical.ca. By using our service, you confirm that you are at least 18.
You may use SameDayMedical.ca only for lawful purposes and in accordance with these terms.
How a Delivery Works
You contact us by phone, text, or through our website to request a same day delivery. We confirm availability, provide a flat rate quote, and agree on a pickup and delivery window before any delivery begins.
A few important points about our delivery process:
Delivery is subject to availability and order time. Same day service is not guaranteed in all circumstances and all areas. We will confirm same day availability before accepting your booking.
You are responsible for ensuring that the items to be delivered are properly prepared, packaged, and ready for pickup at the agreed time.
You are responsible for ensuring that someone is available to receive the delivery at the agreed delivery address and time.
We reserve the right to refuse a delivery request if the items are unsafe to transport, require special handling we are not equipped to provide, or if the request falls outside our service area or operating hours.
We handle all deliveries with care and professionalism. However, we are not responsible for the condition of items that are improperly packaged by the sender or that are inherently fragile beyond standard handling precautions.
If a delivery cannot be completed due to circumstances beyond our control, such as no one being available to receive the delivery, we will contact you to arrange an alternative.
Your Responsibilities
You agree not to misuse SameDayMedical.ca.
Among other things, you must not:
use our service to transport illegal, prohibited, controlled, or dangerous substances or items;
provide false or misleading information about the items to be delivered;
use our service for any unlawful purpose;
attempt to deceive, defraud, or harm our staff, contractors, or other clients;
use our service as a substitute for emergency medical services. If you or someone else is experiencing a medical emergency, call 911 immediately.
Payments and Refunds
Prices are confirmed verbally or in writing before each delivery begins. All prices are in Canadian dollars and are subject to applicable taxes.
Payments may be accepted by credit card, debit card, e-transfer, or other methods as confirmed at the time of booking.
Cancellations made before a driver has been dispatched will receive a full refund. Cancellations made after a driver has been dispatched may be subject to a cancellation fee to cover costs already incurred.
If a delivery cannot be completed due to circumstances within our control, you will receive a full refund or an alternative delivery at no additional charge.
Nothing in these terms limits any refund, cancellation, or other consumer right that cannot legally be excluded or limited under applicable British Columbia or Canadian law.

Our Content and Intellectual Property
SameDayMedical.ca and its software, design, branding, names, logos, content, and other materials provided by us are owned by or licensed to EMPOWER 360 Inc. and are protected by applicable intellectual property laws.
Subject to these terms, we give you a limited, personal, non-exclusive, non-transferable, revocable licence to use SameDayMedical.ca for its intended purposes.
Data and Privacy
Our Privacy Policy explains what information SameDayMedical.ca collects, how it is used and disclosed, and how long it is retained. The Privacy Policy forms part of these terms.
By using our service, you understand that information you provide, including your name, address, phone number, and delivery details, will be used to arrange and complete your delivery.
We will not sell your personal information to third parties. We may share your information with delivery partners and contractors as necessary to complete your delivery.
Availability and Changes to Our Service
We work to provide reliable same day delivery service but cannot guarantee availability at all times or in all circumstances.
We may modify our service areas, operating hours, pricing, or service offerings at any time. We will make reasonable efforts to provide notice of significant changes where practical.
Limitation of Liability
To the maximum extent permitted by applicable law, EMPOWER 360 Inc. and its directors, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to our delivery service.
Our liability for any claim arising from a specific delivery will not exceed the amount paid for that delivery.
We are not responsible for consequences arising from delays caused by circumstances beyond our reasonable control, including traffic, weather, road closures, or failures of third-party partners.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
No Medical or Professional Advice
Your use of SameDayMedical.ca does not create a medical, clinical, pharmaceutical, legal, financial, or other professional relationship between you and SameDayMedical.ca or EMPOWER 360 Inc.
We strongly encourage you to consult qualified healthcare professionals for all medical decisions.
Emergency Services
SameDayMedical.ca is not an emergency service. If you or someone else is experiencing a medical emergency, call 911 immediately. Do not use SameDayMedical.ca as a substitute for emergency medical services.
Governing Law and Disputes
These terms are governed by the laws of British Columbia and the federal laws of Canada applicable there.
Disputes arising out of or relating to these terms or our service may be brought before the courts of British Columbia, Canada.

Changes to These Terms
We may update these terms from time to time. When we do, we will change the Last updated date at the top. Your continued use of SameDayMedical.ca after updated terms take effect means you agree to the updated terms.

These terms, together with our Privacy Policy, form the agreement between you and EMPOWER 360 Inc. concerning your use of SameDayMedical.ca.
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
